
Van Dam & Kruidenier advocaten is a partnership of private limited liability companies. A list of partners will be sent to you on your request.
All orders, either communicated directly to the partnership or to employees of the partnership, shall only be accepted and performed by or on behalf of the partnership. The operation of articles 7:404 and 7:407 paragraph 2 of the Dutch Civil Code (Burgerlijk Wetboek) shall be excluded. These articles concern the person of the party accepting the order. The partnership shall be the party accepting the order to the exclusion of its employees and partners.
Any and all liability on the part of Van Dam & Kruidenier advocaten shall be limited to the amount paid in the matter at hand by the professional liability insurance policy or policies taken out by Van Dam & Kruidenier advocaten, increased by the excess that is for the account of Van Dam & Kruidenier advocaten according to the insurance policy conditions. Information on the professional liability insurance will be sent to you on your request.
When engaging third parties, Van Dam & Kruidenier advocaten will always exercise due care and, to the extent reasonably possible, consult the Client on the engagement of such third parties. Van Dam & Kruidenier advocaten shall not be liable for any shortcomings of such third parties. Van Dam & Kruidenier advocaten shall have the right to accept a possible limitation of liability by third parties also on behalf of its client.
All provisions in these General Terms and Conditions shall also extend to the partners of Van Dam & Kruidenier advocaten, the directors of the partners and any such person who is or has been employed by the partnership.
The legal relationship between Van Dam & Kruidenier Advocaten and its clients shall be governed by Dutch law. Any disputes shall only be adjudicated by the competent Dutch court.
These General Terms and Conditions have been drawn up in Dutch, German, English and French. The Dutch original shall be decisive.
